Defense for Texas Murder Charges

Houston Criminal Attorneys

If you or someone you know is currently under investigation or has been arrested on suspicion of murder, there is no time to waste. Consulting a criminal defense attorney is one of the first things you should do to. You are currently at risk of facing life felony or capital felony charges, and a conviction for these may result in up to life imprisonment, life in prison without the possibility of parole, or the death penalty in some extreme cases. You can be guaranteed that the District Attorney will do everything possible to secure a conviction against you and have you have the highest penalties. You will need an aggressive lawyer to counteract these efforts and protect your Constitutional rights every single step of the way.

What is Murder?

Murder is a form of criminal homicide. Criminal homicide is the offense of taking another person's life without a lawful excuse. Murder is the most serious form of criminal homicide, as it involves deliberate action on the part of the offender. There are different classifications of murder, and the penalties for these may vary depending on the specific case.

Capital Murder - Intentionally and knowingly causing the death of another, when:

  • The victim is a peace officer, fireman, judge or justice of the court
  • The defendant intentionally committed murder during the commission of a felony offense of kidnapping, burglary, robbery, aggravated sexual assault, arson, obstruction, retaliation, or terrorist threats
  • The defendant was paid or paid another to commit murder
  • The defendant committed murder while escaping or attempting to escape from jail or prison
  • The defendant intentionally caused the death of more than one person, either during the same incident or in separate incidents that were a part of the same scheme
  • The defendant murdered a child under the age of 6 years old

Murder - Intentionally and knowingly causing the death of another person, or causing another's death due to the attempt or intention of causing serious bodily injury or of committing a felony offense. Murder is a first degree felony but may be charged as a lesser felony of the second degree if it can be proven by a preponderance of evidence that the defendant committed the act in the heat of passion.
